1. Acceptance of these Terms
These Terms of Use (the “Terms”) form a binding agreement between you (“you,” “your,” “user,” or “member”) and [COMPANY LEGAL NAME], a [STATE] [entity type] (“Command Wellbeing,” “we,” “us,” or “our”), governing your access to and use of the Command Wellbeing website, mental health screeners, AI Peer Support coaching, inbox, library, and related services (collectively, the “Services”).
By creating an account, accessing, or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
Important: The Services are not medical advice and are not a substitute for diagnosis, treatment, or care from a licensed mental health or healthcare professional. See Section 5 (Health Disclaimer) and Section 11 (Disclaimer of Warranties).
2. Eligibility and anonymous account registration
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a legally binding contract to use the Services. The Services are not directed to children under 13, and we do not knowingly collect personal information from them.
Command Wellbeing is built around anonymous accounts. To register you choose a username, a password, and you are issued a one-time recovery code. We do not require, collect, or verify your real name, email address, or phone number. You are responsible for safeguarding your password and recovery code; we cannot recover an account if both are lost.
We may refuse, suspend, or terminate accounts at our discretion, including for violations of these Terms, suspected fraud, abuse, or risk to other users.
3. Description of the Services
The Services include, among others:
- Mental health screeners. Self-administered tools based on validated instruments (including PHQ-9, GAD-7, AUDIT, PCL-5, ACE, ASRS, MDQ, NODS, SCOFF, FTND, GSAQ, NM-ASSIST, OAS, PADIS, PQB, CBI, and others) that generate informational scores and severity bands. A Quick Screen and Full Assessment combine these into a summary report.
- AI Peer Support coaching. Conversational, educational peer-style support from a large language model. Peer Support is not therapy, not a diagnosis, and does not replace a clinician.
- Inbox. A personal area where welcome messages, screener follow-ups, and coaching summaries are delivered for your reference.
- Library. Educational articles on mental health topics, freely available to all members.
We may add, modify, or remove features at any time.
4. Peer Support usage and optional top-ups
Accounts are free. AI Peer Support coaching is included with every account at a flat allowance of 100 messages per calendar month. When you reach the allowance you may, at your option, purchase a one-time top-up of +100 additional messages for US $9.99. Top-ups are processed by our third-party payment processor (Stripe). Command Wellbeing does not store full card numbers.
Top-ups are one-time purchases — there is no auto-renewing subscription. Top-up messages do not expire while your account is active.
Refunds. Except where required by law, top-up purchases are non-refundable once any portion of the additional messages has been used. If you believe a charge is in error, contact us within 30 days at /contact.
Price changes. We may change the top-up price for future purchases. The price displayed at checkout is the price you pay.
5. Health disclaimer — not medical advice
Command Wellbeing provides educational mental wellness information only. The Services do not constitute medical advice, diagnosis, or treatment, and they are not a substitute for the professional judgment of a licensed mental health provider or other healthcare provider.
Screener scores, Peer Support messages, and other outputs are informational signals intended to support discussions with qualified professionals. Never disregard, avoid, or delay seeking professional medical or mental health advice because of something you read or receive through the Services. Do not start, stop, or change any medication based on the Services.
If you may be in crisis, may harm yourself or others, or face a medical emergency, call your local emergency number immediately. In the United States, call or text 988 for the Suicide & Crisis Lifeline, or 911 for emergencies.
6. AI Peer Support — special terms
Peer Support responses are generated by a large language model. They may be inaccurate, incomplete, or out of date, and they will not reflect the judgment of a clinician who knows your history. You should independently verify any information that could affect your health, safety, finances, or relationships.
Conversations are retained to provide and personalize the service, support your account, monitor safety signals, and improve quality. We do not sell the contents of your conversations. You can purge some or all of your coaching history at any time from Account → Coaching privacy. See our Privacy Policy for full details.
We may rate-limit or suspend access to prevent abuse, fraud, or excessive load.
7. Automated translation of clinical content
The Command Wellbeing Services are authored in English. When you select a non-English language, the questions, answer options, severity bands, recommendations, and accompanying copy inside our screeners, the Full Assessment, the Assessment Report, the Quick Screen, and the Quick Screen Results may be displayed using automated machine translation.
These automated translations have not been clinically validated in the target language and have not been reviewed by the original instrument authors or by a licensed clinician fluent in that language. Translated wording and severity labels may not be directly comparable to the published clinical norms, which were established for the validated English version of each instrument.
Scoring math, severity-band thresholds, and the values stored in your account remain based on the canonical English instrument. The English version remains the authoritative source for any clinical or legal interpretation of your results.
By using the Services in a non-English language you acknowledge and accept this limitation.
8. User content and license
You retain ownership of the information you submit to the Services (including screener answers, assessment data, Peer Support messages, and feedback) (“User Content”). You grant Command Wellbeing a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt, and use your User Content as needed to operate, secure, support, and improve the Services and to comply with law.
You represent that you have all rights necessary to submit your User Content and that it does not violate any law or third-party right. You will not submit content that is unlawful, infringing, harassing, deceptive, or that contains malware.
9. Acceptable use
You agree that you will not, and will not attempt to:
- Use the Services for any unlawful, fraudulent, or harmful purpose;
- Impersonate another person, including a healthcare professional, or provide another person’s information without authorization;
- Use the Services to seek or provide individualized clinical care, diagnosis, or prescription decisions for yourself or others;
- Probe, scan, or test the vulnerability of the Services, or breach any security or authentication measure;
- Reverse engineer, decompile, scrape, or copy any portion of the Services except as permitted by applicable law;
- Use Peer Support outputs to train competing AI models or to build a competing product;
- Interfere with or disrupt the Services, servers, or networks, or attempt to gain unauthorized access to any account or system;
- Submit content that infringes intellectual property, privacy, publicity, or other rights, or that is defamatory, harassing, hateful, or otherwise objectionable.
10. Intellectual property
The Services and all content provided by Command Wellbeing (including software, designs, text, graphics, logos, scoring orchestration, coaching prompts, and the “Command Wellbeing” mark) are owned by Command Wellbeing or its licensors and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use.
Validated screening instruments referenced in the Services (for example, PHQ-9, GAD-7, AUDIT, PCL-5, CBI) are the property of their respective copyright holders and are used in accordance with their terms.
11. Third-party services
The Services integrate with a small number of third parties: Stripe (processing optional Peer Support top-ups), our hosting and database providers, and the AI model provider powering Peer Support. Command Wellbeing is not responsible for third-party content, products, or practices. Your use of those services is governed by their terms and privacy policies.
12. Suspension and termination
You may delete your account at any time from Account. We may suspend or terminate your account or access to the Services at any time, with or without notice, for any reason including suspected violation of these Terms or risk to other users.
Upon termination, your right to use the Services ends. Sections that by their nature should survive (including ownership, disclaimers, indemnity, limitation of liability, dispute resolution, and miscellaneous) will survive.
13. Modifications to the Services and Terms
We may update the Services and these Terms from time to time. If we make material changes to these Terms, we will provide reasonable in-product notice before they take effect. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
14. Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. COMMAND WELLBEING AND ITS LICENSORS DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR SECURE, OR THAT ANY INFORMATION OR AI OUTPUT IS RELIABLE, COMPLETE, OR APPROPRIATE FOR YOUR CIRCUMSTANCES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, COMMAND WELLBEING AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR HEALTH OUTCOMES, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
COMMAND WELLBEING’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO COMMAND WELLBEING IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.
16. Indemnification
You agree to defend, indemnify, and hold harmless Command Wellbeing and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Services; (b) your violation of these Terms or any law; (c) your User Content; or (d) your decisions or actions taken in reliance on the Services.
17. Governing law and dispute resolution
These Terms are governed by the laws of the State of [STATE], United States, without regard to its conflict-of-laws principles. Subject to the arbitration provision below, you and Command Wellbeing consent to the exclusive jurisdiction of the state and federal courts located in [COUNTY], [STATE].
Binding arbitration. Any dispute, claim, or controversy arising out of or relating to the Services or these Terms shall be resolved by final, binding, individual arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in [CITY, STATE] or by remote means. Either party may bring claims in small-claims court if eligible.
Class-action waiver. You and Command Wellbeing agree to bring claims only in your individual capacity, and not as a plaintiff or class member in any class, collective, or representative action.
30-day opt-out. You may opt out of arbitration and the class-action waiver by sending written notice through /contact within 30 days of first accepting these Terms.
18. Miscellaneous
These Terms, together with the Privacy Policy and any terms presented at checkout for Peer Support top-ups, are the entire agreement between you and Command Wellbeing regarding the Services. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
Because we do not collect an email address, in-product notices are our primary means of contacting you. Notices to Command Wellbeing must be submitted through /contact.
